These Terms govern your use of CapsuleUs. Please read them carefully — they include important information about your rights and obligations, including around posthumous delivery and data retention.
By creating an account or using CapsuleUs, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app. These Terms apply to all users, including free and paid subscribers.
CapsuleUs lets you create digital "capsules" — collections of photos, letters, voice notes, videos, and documents — and deliver them to recipients now, on a chosen date, or posthumously via trusted guardians. We are a storage and delivery platform; we do not curate, access, or review the content of your capsules except as required by law or our safety policies.
You must be at least 18 years old to use CapsuleUs. By agreeing to these Terms you represent that you are 18 or older. If you are creating a capsule on behalf of a minor recipient, you take full responsibility for the content.
You are responsible for maintaining the security of your account. We authenticate via one-time codes sent to your email — keep your email account secure. You may not share your account with others. You are responsible for all activity that occurs under your account.
You retain ownership of all content you upload. By uploading content, you grant CapsuleUs a limited, non-exclusive licence to store, transmit, and deliver that content to your designated recipients in accordance with the delivery settings you choose. You agree not to upload content that is: • Illegal under applicable law • Sexually explicit involving minors • Designed to harass, threaten, or harm another person • Infringing on a third party's intellectual property rights We reserve the right to remove content that violates these Terms.
Posthumous capsules rely on guardians — people you designate to confirm your passing and trigger delivery. CapsuleUs requires at least two guardians to unlock a posthumous capsule. By adding a guardian you confirm that person has consented to this role. CapsuleUs is not responsible for delays or failures in posthumous delivery caused by guardians who are unavailable, unwilling, or unable to confirm. We strongly recommend you discuss this responsibility with your guardians directly.
CapsuleUs offers a free tier and paid plans (Personal, Family, Legacy). Paid plans are billed monthly or annually via Apple's App Store. Prices are shown in the app and are subject to change with 30 days' notice. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. You can manage and cancel your subscription in your Apple ID account settings. We do not offer refunds except as required by applicable law or App Store policy.
If you delete your account, your capsules and all associated content will be permanently deleted within 30 days. Capsules that have already been delivered to recipients cannot be recalled. Undelivered scheduled or posthumous capsules will be permanently deleted along with your account.
We aim for high availability but do not guarantee uninterrupted service. CapsuleUs is not liable for any loss resulting from service outages, data loss due to technical failure, or delays in delivery caused by infrastructure issues. For critical posthumous delivery needs, we recommend also using traditional legal instruments (wills, letters of instruction) alongside CapsuleUs.
To the maximum extent permitted by law, CapsuleUs and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including loss of data, loss of content, or failure of posthumous delivery. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
These Terms are governed by the laws of Spain, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Madrid, Spain, unless applicable consumer law in your jurisdiction provides otherwise.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of CapsuleUs after the effective date constitutes acceptance of the revised Terms.
